1. General

1.1. This Privacy Policy forms an integral part of the Company’s website terms of use (the "Terms of Use"), which together constitute a single binding legal agreement between the user and the Company. Capitalized terms used in this Privacy Policy shall have the meanings given to them in the Terms of Use unless expressly stated otherwise herein.

1.2. By using the Site or engaging with the Company to receive its Services, you give your full consent to the terms of this Privacy Policy and the Terms of Use. When using the Site to contact the Company, you may be asked to provide personal information such as your full name, company name, email address, phone number, properties, and any additional details required to process the inquiry.

2.3. Information you voluntarily provide to us when applying for a position, expressing interest in the Company’s properties, entering into lease or purchase agreements, or for any other purpose related to the Company’s Services.

It is clarified that you are not legally required to provide these details, and their provision depends solely on your free will and consent. However, failure to provide certain details may prevent you from using some of the Services offered on the Site or from receiving a response to your inquiries.

3. What Types of Information Do We Collect About You?

3.1. Personal Information, including "Information" as defined in the Israeli Protection of Privacy Law, 1981 (the "Privacy Protection Law"). Personal information you provide to the Company will be stored in the Company’s database managed in accordance with the Privacy Protection Law and stored on secured information systems. The Company may use third-party hosting and backup providers in Israel or abroad. Access to the database is in accordance with the Company’s procedures.

3.2. "Personal Information" includes data that can, by itself or together with other data, identify an individual, including registration data, first and last name, email address, and any other personal detail provided to the Company or collected by the Company when using the Site, making contact, entering into lease or purchase agreements, or otherwise (for example, expressing interest as a tenant/purchaser, entering a residential or mailing address, user data, device identifier, usage history, the IP address automatically provided by the network or device used). It may also include information about the manner and pattern of your use of the Site to the extent it relates to a uniquely identifiable user.

3.3. Statistical Information for information services and traffic analysis, analytics, and Site protection services. During your use of the Site, statistical information may be accumulated regarding, among other things, your usage habits, pages viewed, offers and Services that interested you—often via our external suppliers operating within the Site’s environment for the Company.

3.4. For the avoidance of doubt, anonymous statistical information will be retained in accordance with the Company’s procedures and needs subject to applicable law, and any statistical information that is linked or associated with Personal Information may be considered personal information for as long as such link exists.

3.7. In addition to the above, the Company may collect and process further information through advanced tools for analyzing user behavior. Such information may include analysis of browsing and on-Site behavior, content preferences and areas of interest, interactions with marketing content, as well as advanced technical information about the device and browser.

4.1. 5. Purposes of Collecting and Using Information

5.1. Communicating with customers and users; contacting you where the Company believes it is necessary, including updating, confirming, or informing you about matters related to your inquiries and the Services you requested, including customer service, submitting a résumé for a position posted on the Site, interest in projects under marketing, and responding to a service ticket you opened;

5.2. Enabling your use of the Site and any landing page, as well as operating, modifying, and improving the content and Services on the Site and tailoring them to the nature of the Site’s users;

5.3. Providing technical support services and verifying identity for support and Site access where needed via email and/or text messages and/or telephone, based on the details provided during registration;

5.4. Managing, operating, and maintaining the Company’s assets, including managing lease and/or purchase agreements, managing assets as a registration company, collecting payments, handling faults, performing repairs and improvements to assets, and managing relationships with tenants and purchasers;

5.5. Improving our Services, conducting surveys, and generating insights regarding the Company’s marketing and sales processes;

5.6. Complying with legal requirements, including legal proceedings, disclosure orders, or requests from governmental, regulatory, and/or other competent authorities;

5.7. Obtaining general information about users in order to expose you to relevant content and/or to send you from time to time newsletters and/or messages containing updates on new features on the Site and various notices and/or advertisements that we believe you may find of interest, including for direct mailing as detailed in Section 8 below;

5.8. Any other purpose related to providing our Services and enabling the personalization of the Services to your preferences, including any purpose detailed in this Policy and/or in other sections of the Terms and/or a purpose to which you expressly consent;

5.9. Meeting regulatory requirements applicable to the Company’s activity, including reporting to the tax authorities, the Land Registrar, planning and building authorities, and other regulatory bodies.

 

6. Sharing Information with Third Parties

We do not share personal or identifying information collected from you with third parties, except in the following cases:

6.1. Providing information to the Company’s service providers and/or those acting on its behalf, including its business partners, for the purposes of collecting, holding, processing, analyzing, or managing your information, or providing and operating the Company’s Services, including property-management companies, maintenance contractors, legal advisors, accountants, appraisers, brokers, and including for direct mailing as detailed in Section 8 below—all under confidentiality undertakings where such sharing is required;

6.2. The Company may transfer statistical information, for consideration or not, to third parties with whom it has business or other relationships, including companies engaged in analyzing anonymous statistical information, in order to improve the Services offered on the Site and landing pages, or for other purposes, at the Company’s sole discretion;

6.3. To corporations related to the Company and its controlling shareholders, including parent companies, subsidiaries, and their controlled companies;

6.4. Where the Company sought your permission and you gave your explicit consent;

6.5. At your request and/or to respond to your inquiry as requested;

6.6. To identify, prevent, or address security or technical issues and in situations where the Site is used by someone who appears to be unauthorized, in order to prevent fraud and impersonation;

6.7. Where the Company believes that disclosure is necessary to prevent serious harm to the property and/or body of third parties and/or other users and/or any of the Company’s employees and/or any of its customers, or to prevent other injury or damage, at the Company’s discretion;

6.8. Where the Privacy Policy or the Terms of Use have been violated by the user, or in cases where actions contrary to law and/or to the Terms of Use were performed or attempted;

6.9. To comply with any law, regulation, legal process, disclosure order, or governmental request, or an order of a court or other competent authority instructing the Company to provide your details or personal information to the court or authority or to any third party;

6.10. In the event of a dispute, claim, demand, and/or legal proceedings between you and/or anyone on your behalf and the Company and/or anyone on its behalf;

6.11. If the Company organizes the Site’s activity within another corporation or sells the Site’s activity and/or transfers the Site or a landing page, in whole or in part, to any third party, for consideration or not, whether by assignment of rights or by license or sub-license—and also in the event that the Company merges with another entity and/or is sold to another entity and/or merges its activity and/or the Site’s activity with that of a third party—provided that such third party undertakes to comply with the Terms of Use, including this Privacy Policy.

6.12. The Company reserves the right to use any platform, tool, or third-party service existing today or developed in the future that may assist in improving the Services, analyzing data, or promoting its business activity. Use of such services may include transferring information to servers located outside Israel, subject to applicable law and with appropriate security measures. The Company will act to ensure that all service providers and external platforms it uses adhere to high standards of information security and privacy protection.

 

7. User Rights

7.1. As a rule, personal information will be retained in the Company’s databases for the period required to respond to the user’s inquiry on the Site and to provide the relevant Service, as applicable, and as long as the Company has a legitimate need or a legal or other obligation to retain it under applicable law. Anonymous information will be retained in the Company’s systems without time limit (unless prohibited by law).

7.2. The Company will allow you to review personal information about you stored in the Company’s database in accordance with applicable law. We will act to fulfill your request to review, correct, update, or delete the information if you find it to be incorrect, inaccurate, or not up to date, in accordance with our legal obligations, by sending a request to the Company by email as detailed below.

7.3. Before we permit you to review and/or update and/or delete the personal information stored about you, additional steps may be required, such as verifying your identity. After receiving a request to review information, we will act to provide you with the requested information within a reasonable time in accordance with applicable law.

7.4. Please note that deletion of personal information as stated may prevent the Company from acting in accordance with the purpose for which the information was provided, such as when contact details were left in connection with interest in the Company’s Services. If you request that the Company delete your personal information, the Company reserves the right—and you hereby consent—to anonymize the personal information.

7.5. Notwithstanding the foregoing, personal information required by the Company for the continued management of its business and/or for a legitimate purpose such as defending against claims, if required, will continue to be retained by the Company for the period required by law; access to such information will be limited to legal or technical needs only.

7.6. You acknowledge and agree that information about you may also be transferred outside the borders of the State of Israel, including for storage and processing, in accordance with applicable law.

 

8. Direct Marketing and Advertising

8.1. Providing your personal details on the Site, a landing page, within lease or purchase agreements, or by any other means constitutes your explicit consent to receive emails and/or text messages (SMS) from the Company, including service messages (such as messages related to Services provided by the Company, updates regarding the Company’s Services, including additional Services) and messages containing content that constitutes an "advertisement" under Section 30A of the Communications Law (Telecommunications and Broadcasting), 1982. Such messages may include value offers regarding the Company’s Services and products, relating to products or Services similar to those you consume, including information about the Company’s activity and/or products and Services offered by it, properties for lease or sale, events and conferences, professional reviews, etc., and may be sent by various means including email, electronic message, SMS, WhatsApp, push notifications, fax, and automatic dialing systems.

8.2. You may, at any time, notify the Company of your wish to be removed from the distribution list for "advertisements" via one of the alternatives specified in the advertisement and/or by contacting us through other communication channels. In such a case, the Company will refrain from sending advertising messages only. For the avoidance of doubt, this does not preclude the Company from sending service messages.

8.3. Some of the Company’s communications to you may be made on a personalized basis, according to belonging to a population group defined by one or more characteristics of persons whose names are included in a database. Under applicable law, you are entitled to request in writing that information relating to you be deleted from the database used for direct mailing.

 

9. Links to Third-Party Websites

9.1. Certain links on the Site allow you to access websites or online information sources that are not owned by the Company. In addition, as part of the Services, the Company may refer you to external service providers. Such linked websites and service providers are not under the Company’s control, and the Company is not responsible for the availability of such external websites or information sources or for their privacy policies, including their data-collection practices.

9.2. The Company shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, offer, or service available on or through links available on or linked to the Site. Most of these linked websites provide legal documents, including terms of use and privacy policies applicable to the use of those websites, and we recommend that you read such documents carefully before using them.

 

10. Minors

The Site and the Services are intended only for persons 18 years of age and older.

 

11. Information Security

The Company operates in accordance with accepted standards and applicable law. The Company implements advanced security measures and cyber-protection systems. Please note that these systems reduce the risks of unauthorized access to the Company’s platforms and servers, but they do not provide absolute protection against intrusion and/or unauthorized access. Accordingly, the Company does not warrant that the servers will be completely immune to unauthorized access and/or use of the information stored on them. The Company shall not be liable for any disclosure or use of such information resulting from unauthorized intrusions by others.

12.1. We reserve the right to change the terms of this Privacy Policy from time to time and as needed, at our sole discretion, without any obligation to provide prior or subsequent notice. Any changes, if made, will take effect immediately upon posting the updated Privacy Policy on the Site. Therefore, we recommend reviewing this Privacy Policy from time to time. Your continued use of the Site after such changes constitutes your consent to those changes and to the updated Privacy Policy. If you do not agree to the foregoing changes, in whole or in part, please refrain from continuing to use the Site or contact us for assistance. If we make changes that, in our judgment, materially affect your rights, we may take reasonable steps to display a prominent notice regarding such changes on the Company’s Site or by email alert.
