We, Blue Square Real Estate Ltd., of 1 Azrieli Street, Circular Tower, Tel Aviv, as well as affiliated companies from the Alon Blue Square Israel Ltd. group (the “Company” or “we”, “us”, “our” and their derivatives), respect your privacy, and therefore undertake to make every effort to protect it. The purpose of this Privacy Policy (“Privacy Policy” or the “Policy”) is, among other things, to explain the Company’s practices regarding the privacy of users of the websites and digital assets (“Users” or the “User”) operated by the Company, including at the addresses https://www.bsre.co.il, https://alon-center.co.il, https://tlvmall.co.il, including any application or other digital platform that the Company uses in connection with marketing activities or any other activity vis-à-vis the Users (the “Site”), and also regarding the privacy of the Company’s customers, including tenants, residents and purchasers, within all of its business activities, including rental activities in income-producing real estate, sale of assets, activity as a housing company, parking operations and other services that the Company provides (the “Services”).

This Policy is written in the masculine form for convenience only, but is intended for both women and men alike.

1. General
1.1. This Privacy Policy constitutes an integral part of the Company’s website terms of use (the “Terms of Use”), which together form one binding legal agreement between the User and the Company. Terms in the Privacy Policy shall have the same meaning as defined in the Terms of Use, unless explicitly stated otherwise herein.
1.2. By using the Site or by engaging with the Company to receive its Services, you give your full consent to the terms of this Privacy Policy and the Terms of Use. If you do not agree to these terms, in whole or in part, please refrain from making any use of the Site or from engaging with the Company to receive its Services.

2. Provision of Personal Information
2.1. The Company may collect information about Users through the use of the Site as well as about its customers במסגרת provision of the Services. 2.3. Information that you provided to us voluntarily, when you wish to contact us for the purpose of submitting a job application, expressing interest in the Company’s assets, entering into lease or purchase agreements, or for any other purpose related to the Company’s Services.

It is clarified that you are not legally obligated to provide these details, and their provision depends solely on your free will and consent. However, failure to provide certain details may prevent you from using some of the services offered on the Site or from receiving a response to your inquiries.

You may refrain from providing certain personal data; however, you acknowledge that this may prevent us from providing you with certain services or using our platforms. Our platforms are available to relevant users, visitors or customers, and certain functions may require registration and submission of certain personal data, as described in this Privacy Policy. We will retain the personal data that you provide to us on the Site and in the Services in accordance with this Privacy Policy.

3. What Types of Information Does the Company Collect About You?
3.1. Personal information including “personal information” according to the Privacy Protection Law, 1981 (the “Privacy Protection Law”). The personal information that you provided to the Company will be stored in a database under the Company’s control, managed in accordance with the Privacy Protection Law and stored on secure information systems. The Company may use hosting and backup servers via third parties in Israel or abroad. Access to the database is in accordance with Company procedures.
3.2. In this context, “personal information” is the totality of data that may in itself, or when combined with other data, be used to identify a person, including registration data, first and last name, email address and any other personal detail that will be provided to the Company or that the Company collects during use of the Site, contacting the Company, entering into lease or purchase agreements, parking activity or in any other way (for example, interest as a tenant/purchaser, entering a residential/mailing address, user data, device identifier, usage history, IP address automatically provided by the network or device used, vehicle license number when using parking services (we are not able to identify the data subject and link it to the license number, except with respect to subscribers and registered users, regarding whom additional personal information may also be collected, in accordance with this Privacy Policy)). Also, information regarding the manner and way you use the Site insofar as it includes characteristics identifying a single user.
3.3. Statistical information for the purpose of information services and traffic analysis, analytics and protection services for the Site. When using the Site, statistical information may accumulate, including regarding your habits, the pages you viewed, the offers and services that interested you, in most cases through our external providers operating in the Site environment on behalf of the Company.
3.4. For the avoidance of doubt, anonymous statistical information will be retained in accordance with Company procedures and needs subject to applicable law, and any statistical information that is related or linked to personal information may be considered personal information as long as such linkage exists.
3.5. “Statistical information” is information containing various data that do not identify and cannot, in themselves, reveal your identity or their source. Statistical information includes anonymous, technical information and information collected about user behavior, and may include, among other things, the manner and way the user operates on the Site, the identity of the operating system and browser type, mobile device type and version, device language, click stream, typing intensity, form and manner, etc. The statistical information we collect (and, at the Company’s discretion and with its approval, by third parties) may include information about your usage habits and behavior patterns on the Site, the services you requested, the geographic location of the device from which you accessed the Site, browser and the like.
3.6. in the Services, the Company may collect additional information such as: identification details of current or potential tenants, residents and purchasers, financial documents, guarantees, checks, bank account details, payment history, insurance details, and other information required for entering into lease or purchase agreements and managing ongoing business relationships.
3.7. In addition to the above, the Company may collect and process additional information using advanced tools for analyzing user behavior. This information may include analysis of browsing patterns and behavior on the Site, content preferences and areas of interest, interactions with marketing content, and advanced technical information about the device and browser.

4. Cookies and Local Storage
4.1. During use of the Site, the Company and/or third parties may use a variety of advanced tracking technologies, including technology commonly accepted in the industry and known as “cookies”, social media pixels, advanced analytics tools, remarketing and targeted advertising technologies, web beacons and local storage technologies, which allow the Site to identify your browser, store certain information on the user’s mobile device and/or computer, enabling the Company to operate certain features on the Site automatically, and other adjustments to improve user experience or to enable automatic login processes to the Site and the Company’s Services.

4.2. Cookies may be collected by us or by third-party providers for the purpose of analyzing your interaction with the use of our Site. 4.7. The Company reserves the right to implement on the Site any type of plugin, pixel, or other tracking technology, existing today or developed in the future. Such use may include advanced data analysis systems, advertising and marketing platforms, optimization and personalization tools, marketing automation systems and additional technologies that will serve the Company’s purposes. Any use of such technologies will be subject to this Privacy Policy and applicable law.

5. Purposes of Collection and Use of Information
5.1. Communication with customers and users; to contact you when the Company believes there is a need to do so, including updating, confirming or informing you regarding matters related to your inquiries and the Services you requested, including customer service matters, submission of resumes for a position published on the Site, interest in a project(s) under marketing and response to a service request you opened;

5.2. In order to enable you to use the Site and any landing page, as well as for the purpose of operating, modifying and improving the content and services on the Site and adapting them to the nature of the Site’s users;

5.3. To provide technical support services and for verification purposes in order to provide support services and access to the Site when necessary via email and/or text messages and/or telephone response according to the details provided at registration;

5.4. For the purpose of managing, operating and maintaining the Company’s assets, including parking lots under its management and including management of lease and/or purchase agreements, management of assets as a housing company, collection of payments, handling malfunctions, performing repairs and improvements in assets, managing relationships with tenants and purchasers, operating malls and offering benefits or collaborations with businesses operating in the Company’s assets by third parties;

5.5. Improving our services, conducting surveys and deriving insights regarding the Company’s marketing and sales processes;

5.6. To comply with any legal requirement, including for the purpose of legal proceedings, orders, including disclosure orders or requests by governmental, regulatory and/or any other competent authority;

5.7. In order to receive general information about users in order to offer you exposure to relevant content and/or send you from time to time newsletters and/or messages, including updates about new features on the Site and various notices and/or advertisements, which we believe you may find of interest, including for mailing purposes as detailed in section 8 below;

5.8. For any other purpose in connection with the provision of our Services, and to enable customization of the Services to your preferences, including any purpose detailed in this Policy and/or in other sections of the Terms of Use and/or a purpose to which you explicitly agree;

5.9. For the purpose of complying with regulatory requirements applicable to the Company’s activities, including reporting to tax authorities, the Land Registry, planning and construction authorities, and other regulatory bodies.

6. Sharing Information with Third Parties
We do not share personal or identifying information collected from you with third parties, except in the following cases:

6.1. Provision of information to the Company’s service providers and/or those acting on its behalf, including its business partners (including businesses operating within the Company’s assets), for the purpose of collecting, holding, processing, analyzing or managing your information, or providing and operating the Company’s Services, including property management companies, parking operators, maintenance contractors, legal advisors, accountants, appraisers, brokers, including for mailing purposes as detailed in section 8 below, all subject to confidentiality obligations where such sharing is required;

6.2. The Company may transfer statistical information, with or without consideration, to third parties with whom it has business or other relationships, including companies engaged in analysis of anonymous statistical information as aforesaid, for the purpose of improving the services offered on the Site and landing page, or for other purposes, at the Company’s sole discretion;

6.3. To corporations affiliated with the Company and its controlling shareholders, including parent companies, subsidiaries and companies under their control;

6.4. If the Company requested your permission and you gave your explicit consent;

6.5. Upon your request and/or in order to respond to your request;

6.6. To identify, prevent or address security or technical issues and in situations where the Site is used by someone who appears to be unauthorized, in order to prevent fraud and impersonation;

6.7. Where the Company believes that providing the information is necessary in order to prevent serious harm to the property and/or person of third parties and/or other users and/or Company employees and/or its customers, or to prevent other harm or damage at the Company’s discretion;

6.8. In the event that the user violated the Privacy Policy or Terms of Use and/or in cases where actions were taken or attempted that are contrary to any law and/or the Terms of Use;

6.9. To comply with any law, including any statute, regulation, legal proceeding, disclosure order or governmental order or request of a court or any competent authority or other authority, instructing the Company to provide your details or personal information about you;

6.10. Due to a dispute, claim, demand and/or legal proceedings conducted between you and/or anyone on your behalf and the Company and/or anyone on its behalf;

6.11. If the Company organizes the Site’s activity within another corporation or sells the Site’s activity and/or transfers the Site or landing page, in whole or in part, to any third party, with or without consideration, whether by assignment of rights or by license or sublicense – as well as in the event that the Company merges with another entity and/or is sold to another entity and/or merges its activity and/or the Site’s activity with that of a third party, provided that such third party undertakes to comply with the Terms of Use, including this Privacy Policy;

6.12. The Company reserves the right to use any third-party platform, tool or service existing today or developed in the future, which may assist in improving services, analyzing information, or promoting its business activities. Use of such services may include transfer of information to servers located outside the borders of Israel, subject to applicable law and appropriate security measures. The Company will act to ensure that all service providers and external platforms it uses are committed to high standards of data security and privacy protection.

7. Users’ Rights
7.1. As a general rule, personal information will be retained in the Company’s databases for the period required by the Company in order to respond to the User’s inquiry on the Site and to provide the relevant service to the User, as applicable, and as long as the Company has a legitimate need or legal or other obligation to retain it under any law. Anonymous information will be retained in the Company’s information systems without time limitation (as long as this is not prohibited under any law).

7.2. The Company will allow you to review the personal information about you that has been accumulated in the Company’s database in accordance with applicable law. We will act to fulfill your request to review, correct, update or delete the information if you find that the information is incorrect, inaccurate or not up to date, in accordance with our obligations under the law, provided that you request to correct, update or delete the information by sending a request to the Company by email as detailed below.

7.3. Before we allow you to review and/or update and/or delete the personal information accumulated about you, we may require additional actions, such as verification of your identity and the like. After we receive a request to review information, we will act to provide you with the requested information within a reasonable time in accordance with the law.

7.4. Please note that deletion of personal information as aforesaid may prevent the Company from acting in accordance with the purpose for which the information was provided, for example where details were left במסגרת an inquiry regarding the Company’s services. If you request that the Company delete your personal information, the Company reserves the right, and you hereby approve the Company, to convert the personal information into statistical information that will not enable your identification.

7.5. Notwithstanding the above, personal information required by the Company for the purpose of continuing to manage its business and/or required for a legitimate purpose such as defense against claims, if required, will continue to be retained by the Company for the period required by law, however access to it will be restricted for legal or technical purposes only.

7.6. You confirm and agree that information about you may be transferred outside the borders of the State of Israel, including for the purpose of storage and processing, in accordance with the provisions of the law.

8. Direct Mailing and Advertisement
8.1. Providing your personal details on the Site, on a landing page, במסגרת entering into lease or purchase agreements, or by any other means, constitutes your explicit consent to receive emails and/or SMS messages from the Company, including service messages (such as messages related to the services provided by the Company, updates regarding the Company’s services, including additional services), and messages containing content that meets the definition of “advertisement” under Section 30A of the Communications Law (Telecommunications and Broadcasting), 1982. These messages may include value offers regarding the Company’s services and products, relating to products or services similar to those consumed by the user, including information about the Company’s activities and/or products and services offered by it, properties for rent or sale, events and conferences, professional reviews, etc., by various means including email, electronic messages, SMS messages, WhatsApp messages, push notifications and notifications, facsimile and automatic dialing systems.

8.2. You may, at any time, notify the Company of your desire to remove your address from the distribution list of “advertisement” recipients through one of the alternatives specified in the advertisement message and/or by contacting us through other communication channels. In such case, the Company will refrain from sending messages containing advertisements only. It is clarified that this does not prevent the Company from sending service messages.

8.3. It is possible that some of the Company’s communications to you will be made as part of a personal approach, based on belonging to a population group determined according to one or more characteristics of persons whose names are included in the database. According to the law, you are entitled to demand in writing that information relating to you be deleted from the direct mailing database.

9. Links to Third-Party Websites
9.1. Certain links on the Site allow you to access websites or information sources on the internet that are not owned by the Company. These linked websites and service providers are not under the Company’s control and it is not responsible for the availability of such external websites or information sources or their privacy policies, including information collection.

9.2. The Company shall not bear any responsibility, directly or indirectly, for any damage or loss caused or alleged to have been caused by or in connection with the use of or reliance on any content, offer or service available in or through links available on or linked to the Site. Most of these linked websites provide legal documents, including terms of use and privacy policies applicable to the use of those websites, and we recommend that you read these documents carefully before using such websites.

10. Minors
The Site and the Services are intended only for individuals aged 18 and over.

11. Information Security
The Company operates in accordance with accepted standards and applicable law. The Company implements advanced security measures and protection systems against cyber risks. Please note that these systems reduce the risks of unauthorized intrusion into the Company’s platforms and servers, however they do not provide absolute security against breaches and/or unauthorized access as aforesaid. In light of the above, the Company does not undertake that the servers will be completely immune from intrusion and/or unauthorized access to the information stored therein. The Company shall not bear any responsibility in cases of disclosure and use of such information resulting from unauthorized intrusions by others.

12. Changes to this Privacy Policy and Contact
12.1. We reserve the right to change the terms of the Privacy Policy from time to time and as needed at our sole discretion, and even without obligation to provide prior and/or retrospective notice. Changes that are made, if made, will come into effect immediately upon presentation of the updated Privacy Policy on the Site. Therefore, we recommend reviewing this Privacy Policy from time to time. Your continued use of the Site after such changes will indicate your consent to those changes and to the updated Privacy Policy. If you do not agree to the aforementioned changes, in whole or in part, please refrain from continuing to use the Site or contact us for assistance. It should be noted that if we make changes which, at our discretion, materially affect your rights, we may take reasonable measures to present a prominent notice of this on the Company’s Site or via email notification.
